Notice was given by publication in The Cape Cod Times, a <br /> newspaper of general circulation in the Town of Mashpee, on August 27, 2004 and <br /> September 3, 2004 a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 22, 2004, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James Regan, Robert Nelson, <br /> Zella Elizenberry, Richard Guerrera and Marshall Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Murphy represents himself at this hearing. He currently owns a farm <br /> whereby he boards horses and would like a permit to have riding lessons for children and <br /> adults, breed horses and board up to ten horses. Mr. Murphy said he looking for <br /> guidance as to what types of permits he needs to do this and needs the income from <br /> boarding the horses. Mr. Regan reads a letter from the DPW with respect to some <br /> problems at his property. They believe he is responsible for some drainage run off and <br /> there have been a lot complaints with the Board of Health as to the cleanliness of the <br /> horse farm. The Board looks into the zoning of a horse farm and it appears that it <br /> requires 5 acres to have this type of farm. Mr. Murphy's property contains only 30,000 <br />
