Mashpee Zoning <br /> Board of Appeals Minutes <br /> 1 September 22, 2004 <br /> TOWN OF MASHPEE <br /> Zoning Board of Appeals <br /> Minutes—Wednesday, September 22, 2004 <br /> The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, September <br /> 22, 2004 at 7:00 P.M. at the Mashpee Town Hall. Board Members James Regan, Robert <br /> Nelson, Zella Elizenberry, Richard Guerrera and Marshall Brem were present. Alternate <br /> Frederick Borgeson was also present. <br /> Chairman James Regan is not sitting on Southside Realty Trust and therefore asked Mr. <br /> Nelson to open the meeting for this evening. He will rejoin the board after the hearing is <br /> completed. <br /> Mr. Nelson brought the meeting to order at 7:00 <br /> Southside Realty Trust: Requests a Major Modification to the Comprehensive Special <br /> Permit under Massachusetts General Laws Chapter 40B granted May 5, 2004 for the <br /> Main Street Village Project. The modification will consist of the addition of 2 quadplex <br /> units and corresponding garage units, one on lot#9 and one on lot #10 located in a C-2 <br /> and R-5 zoning district at 334 Main Street (Route 130) (Map 36 Parcel 47) Mashpee, <br /> MA. Owner: SM Realty Trust , John and Gaile McShane Trustees. <br /> Sitting: Robert Nelson, Marshall Brem, Richard Guerrera, Zella Elizenberry, and <br /> Frederick Borgeson. James Regan stepped down from this hearing. <br /> Town Attorney Jason Talerman is present for the Modification of the Comprehensive <br /> Special Permit that was granted for the McShane Chapter 40B project that is slated to <br /> begin shortly. They have petitioned for 8 additional units and are represented by Attorney <br /> Kevin Kirrane. Matt Teague, Project Manager.is also present. It was always the <br /> intention of petitioner to have a total of 24 units at this property. However, due to some <br /> procedural situations with Mass Housing and the fact the several town officials were in <br /> litigation with the previous owner of this property, it was decided that petitioner would <br /> reduce his request to 16 units and file for the additional 8 units as soon as the situation <br /> allowed itself. The Board and Mr. Kirrane review all of the paperwork and the new <br /> locations of where these additional units will be placed. They discuss the total number of <br /> affordable units, the moderately affordable and the market rate homes. Nothing will <br /> change with respect to those provisions except an increase of available units to residents. <br /> There will be 6 units of"affordable' houses whereby the applicant can earn no more than <br /> 80% of the median income, 4 units of"moderately affordable' houses whereby <br /> applicants can earn no more than 120% of the median income and 14 market rate homes. <br /> The board questions how they will target Mashpee residents and if they can do that. <br /> Attorney Talerman informs them that they can commit up to 70% of affordable to the <br /> Mashpee residents and there is a portion of the decision that specifically deals with that. <br />
