Mashpee Zoning <br /> Board of Appeals Minutes <br /> 4 September 22, 2004 <br /> Plymouth Savings Bank: Requests a Special Permit from Section 174-54 of the Zoning <br /> By-laws in order to have signage and illumination in a commercial district on property <br /> located in a C-1 zoning district at 6 Shellback Way (Map 81 Parcel 36) Mashpee, MA. <br /> Owner: Charles C. Hajjar Trust, Falmouth Road Trust <br /> Sitting: James Regan, Robert Nelson, Marshall Brem, Zella Elizenberry, Richard <br /> Guerrera and Frederick Borgeson. <br /> Attorney Kevin Kirrane represents the petitioner at this continued hearing. Also present is <br /> Senior Vice President Louis Kruger and Engineer Charles Rowley. Mr. Kirrane informs <br /> the Board that they have made several changes to accommodate the Boards requests and <br /> well as meet with the Planning Board. Mr. Kirrane notes that the Planning Board was <br /> actually in favor of the first set of plans, however, they will move forward with what is <br /> before the ZBA now. He offers a landscape plan for the file since there does not appear <br /> to be one. They have eliminated one of the entranceways at Shellback Way as the plan <br /> reflects. The Board reviews the plans and feels that the variance portion of this request <br /> could be addressed this evening. Mr. Regan also notes that input from Greg Taylor, DPW <br /> and Deputy Chief Hamblin was received. He would like section(b) of Mr. Taylor's <br /> memo incorporated into the plans and adhered to. The Fire Department is in agreement <br /> with the present proposed plans. Mr. Regan asks for comments from the audience. <br /> Charles LaSalla, Owner of True Value in Mashpee: He reviews the plans and asks <br /> what changes have been made to the parking in front of his store. Marshall Brem informs <br /> him that nothing will change for him, which is what the Board wanted. He thanks thein <br /> for their time and says he is no longer opposed to the plans. Mr. Nelson moves to grant <br /> the following variances (1) a 25-foot variance for the parking from Falmouth Road to the <br /> paving line; and (2) a 36.5-foot variance from the canopy to the lot line. Marshall Brem <br /> seconds the motion. All agree. So moved. Reference most recent plans with revisions. <br /> The next portion of this permitting process is the sign request. Currently, they are <br /> requesting an internally lit self-illuminating sign with the time and temperature on it. <br /> The Board does not have any pictures or information on the sign will look like. Design <br /> Review has noted that the Board of Selectmen needs to approve any self-illuminating <br /> signs and therefore, the applicant should proceed in that manner. It is decided that the <br /> applicant will request a continuance until October 13, 2004 to research this matter <br /> further. The Board agrees and the matter is continued until October 13, 2004. So moved. <br /> Richard Kearney: Requests a Special Permit from Section 174-20 of the Zoning By- <br /> laws to demolish the existing dwelling and rebuild a new dwelling on property located in <br /> an R-3 zoning district at 429 Monomoscoy Road (Map 124 Parcel 54) Mashpee, MA. <br /> Sitting: James Regan, Robert Nelson, Zella Elizenberry, Marshall Brem, and Richard <br /> Guerrera. Present: Frederick Borgeson. <br /> Attorney Kevin Kirrane represents the applicant at this continued hearing. Also present <br /> is Engineer Michael Grotzke, and Architect Tom O'Neil for applicant.
