Indenture of Trust 18 Cross Tree Way <br /> Of Fried, Freida D. Ramaswamy, Map 112 Parcel 22 <br /> Trustee SP-04-125 <br /> A Petition was filed on September 2, 2004 by Rev. Indenture of Trust of Fried, <br /> Freida D. Ramaswamy, Trustee for a Special Permit under Sections 174-17 of the Zoning <br /> By-laws for permission to demolish an existing non-conforming dwelling and construct a <br /> single-family home on property located in an R-3 zoning district at 18 Cross Tree Way <br /> (Map 112 Block 22) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on September 24, 2004 and <br /> October 1, 2004, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, October 13, 2004, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: James E. Regan III, Zella E. Elizenberry <br /> and Frederick R. Borgeson, and Robert Nelson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Michael Grotzke of the Phoenix Group represented the petitioner along with <br /> Architect Tom O'Neil. They are seeking a special permit in order to alter a pre-existing <br /> non-conforming structure. The Board reviews the site plan and the architectural plans. <br /> Mr. O'Neil explains to the Board that he has designed the new structure to fit in with the <br /> neighborhood. The New Seabury Architectural Review Committee feels this will be a <br /> big improvement to the neighborhood. Mr. Nelson and Mr. Regan discuss the fact that <br /> the proposed dwelling will not meet the current setback requirements. Mr. Grotzke told <br /> j <br />
