Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on September 24, 2004 and <br /> October 1, 2004 a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, October 13, 2004 at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: James E. Regan III, Zella E. Elizenberry <br /> and Frederick R. Borgeson and Robert Nelson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Brian Kantor represents himself at this hearing. He is seeking a special permit to <br /> demolish the existing dwelling. He presents plans to the Board as well as pictures of area <br /> houses that have accomplished the same request he is setting out to do. This would be an <br /> improvement to the area for what exists on the two lots now. The shed would be torn <br /> down building this new dwelling would eliminate the encroachment that currently exists <br /> on the adjoining lot. This area in Monomoscoy Island predates zoning. An abutter, Ted <br /> O' Rourke of 37 Great River Road fully supports the permitting application. The lot <br /> coverage being proposed is 14% and a very technical new septic system is going to be <br /> installed since it is on the water.
