t - Town of c^ <br /> %.' 16 Grcat,NEA koad,1Nor d t <br /> Allashpee, lllassach.usetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Variance <br /> RE: Brian Kanter 36 and 40 Great River Road <br /> Map 120 Block 69 and 70 <br /> V-04-130 <br /> A Petition was filed on September 21, 2004 for a Variance from Section 174-31 <br /> of the Zoning By-laws for permission to vary the setback requirements to allow for <br /> construction of a single-family home on property located in an R-3 zoning district at 36 <br /> and 40 Great River Road (Map 120 Block 69 and 70) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on September 24, 2004 and <br /> October 1, 2004, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, October 13, 2004, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: James E. Regan III, Zella E. Elizenberry <br /> and Frederick R. Borgeson and Robert Nelson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Brian Kantor represents himself at this hearing. He is seeking a variance for relief <br /> from the setback requirements. He presents plans to the Board as well as pictures of area <br /> houses that have accomplished the same request he is setting out to do. This would be an <br /> improvement to the area for what exists on the two lots now. The shed would be torn <br /> down building this new dwelling would eliminate the encroachment that currently exists <br /> on the adjoining lot. This area in Monomoscoy Island predates zoning. An abutter, Ted <br /> O' Rourke of 37 Great River Road fully supports the permitting application. The lot <br /> coverage being proposed is 14% and a very technical new septic system is going to be <br /> installed since it is on the water. Conservation has approved the request as well as the <br /> Board of Health for a 3 bedroom dwelling with DEP concurrence. Frederick Borgeson <br /> moves to grant the following: <br />
