Mashpee Zoning <br /> Board of Appeals Gerald Gaffin, Michael Rockoff <br /> 3 Applicant: Clover Paving Co., Inc. <br /> V-04-132 <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> SPECIFIC FINDINGS <br /> 1. that there are circumstances relating to the shape and topography that affect <br /> the subject lot and not the district in which it is located. <br /> 2. that a literal enforcement of the By-laws would involve hardship to the <br /> Petitioner. <br /> 3. that relief may be granted without detriment to the public good. <br /> 4. that relief may be granted without derogating from the intent or purpose of the <br /> By-laws. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded, the Zoning Board of Appeals voted unanimously on October 27, <br /> 2004 to grant a 310 foot frontage variance on Route 28. Reference plans from Falmouth <br /> Engineering, dated June 8, 2004, revised on the following dates: July 23, 2004, August <br /> 27, 2004, September 3, 2004 and September 28, 2004, Project No. 04062 as prepared for <br /> Clover Paving Co., Inc., and Architectural Plans from JB Designs of West Barnstable, <br /> MA, dated September 8, 2004. <br />
