6oWri At <br /> "lown oJ'Mashpcc <br /> � 16 Great Xieck Pvoad Nc)rth <br /> lVashpec, Allassachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Special Permit <br /> RE: Victor Corda 184 Waterway <br /> Map 111 Parcel 94 <br /> SP-04-134 <br /> A Petition was filed on September 21, 2004 by Victor Corda of Wellesley, <br /> Massachusetts, for a Special Permit under Section 174-25.I.9 of the Zoning By-laws to <br /> allow for construction of a pier, ramp and float in Popponesset Creels on property located <br /> in an R-3 zoning district at 184 Waterway (Map 111 Parcel 94) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on September 24, 2004 and <br /> October 1, 2004, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, October 27, 2004 at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Zella E. Elizenberry, Robert Nelson and <br /> Marshall A. Brem, Frederick Borgeson and Richard Guerrera. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Victor Corda represented himself at this hearing. His original application for this <br /> pier, ramp and float to be constructed expired on September 9, 2004 and he was not <br /> aware that it had. He informs the Board that nothing has changed with his proposed <br /> plans and he would just like to have this approved again. The Board sees no problem <br /> with this and moves to grant the Special Permit. <br /> No comments were received from abutters. <br /> SPECIAL PERMIT CRITERIA <br /> Section 174-25.I.9 states that the Board must find that the structure will not <br /> unduly interfere with the free passage of travel by water or land or cause or contribute <br />
