Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on October 8, 2004 and <br /> October 15, 2004, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, October 27, 2004 at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Zella E. Elizenberry, Robert Nelson and <br /> Marshall A. Brent, James Regan and Richard Guerrera. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> David Sanicki of Cape & Islands Engineering represents the petitioners at this <br /> hearing. They are seeking a special permit in order to build a pier, ramp and float on <br /> Hamblin Pond. Mr. Sanicki informs the Board that one of the abutters the Moore Family, <br /> wanted the dock moved; however, the Harbor Master Perry Ellis does not want it where <br /> the Moore's have suggested it to be. They are also concerned about the lighting that was <br /> discussed in the application—they simply want electricity brought out to the dock to <br /> wash the boat or do some repair work. The Moore's seem placated with this information. <br /> There is a state requirement of 5 feet on the height of the mean high water. After some <br />
