tawry <br /> Crr✓ +,;;:tJy <br /> Town of Mashpee <br /> N <br /> 16 Great jV cck Pvoad oi-th, <br /> 12llash,pce 1)'lassochLisetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Variance <br /> RE: James and Amy Newman 34 Oneida Avenue <br /> Map 65 Block 120D <br /> V-04-147 <br /> A Petition was filed on October 5, 2004 by James and Amy Newman for a <br /> Variance from Section 174-31 of the Zoning By-laws for permission to vary the sideyard <br /> and frontyard setback requirements to allow for construction of an addition and a deck to <br /> an existing dwelling on property located in an R-5 zoning district at 34 Oneida Avenue <br /> (Map 65 Block 120D) Maslipee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on October 8, 2004 and <br /> October 15, 2004, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, October 27, 2004, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: James E. Regan III, Robert G. Nelson, <br /> Richard T. Guerrera, Zella Elizenberry and Marshall Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Ken Michaels, Builder for the Newmans is present along with Mrs. Amy <br /> Newman, petitioner. They are seeking a variance in order to vary the setback <br /> requirements to build an addition and increase the side of the deck. Mr. Michaels informs <br /> the Board that they have a corner lot which puts an extra burden on them to conform. <br /> Conservation has issued an order of conditions. The Board reviews the plans. Robert <br /> Nelson makes a motion to grant a 13.83 foot variance to Canochet Avenue, a 9.75 foot <br /> variance to Oneida Avenue, an 18.15 foot variance on the westerly side and a 66,642 <br /> square foot landspace variance. Zella Elizenberry seconds the motion. All agree So <br />
