MERRICK, LOUISON & COSTELLO, LLP
Mashpee Zoning Board of Appeals
December 8, 2004
Page 3
feet would,in my opinion, be inconsistent with the clear historical references to and depictions of
Rock Landing Road set forth in the deeds and plans of record and could conceivably interfere with
the rights of others in this way. For the purposes of this opinion, I understand that Rock Landing
Road does exist, physically, on the ground. It is also noteworthy that to the extent that others
possess an interest in this 50 feet x 40 feet portion of Parcel 1 as identified in the 1991 MacKinnon
Deed, there is a question as to whether the "one ownership" component of the definition of a Lot
in the Mashpee Zoning By-law has been met.
For the reasons set forth herein,.it is my opinion that the MacKinnon property would be
considered two separate lots under the Mashpee Zoning By-law due to the layout of Rock Landing
Road within said property.
Please contact me if you have any further questions in this regard.
Ve VkJ.
l urs,
Paostello
PJC/alg
cc: Joyce M.
