Mashpee Zoning <br /> Board of Appeals Minutes <br /> 5 November 10, 2004 <br /> Charice DiPlacido Tr/DMC Realty Trust: Requests a Special Permit from Section <br /> 174-25 I.9 of the Zoning By-laws to construct and license a new pier, ramp and float with <br /> maintenance and perpetuity and to remove the existing pier, ramp and float(interim <br /> approval 2758) on property located in an R-3 zoning district at 98 Summersea Road (Map <br /> 105 Parcel 45) Mashpee, MA. <br /> Sitting: James Regan, Robert Nelson, Zella Elizenberry, Richard Guerrera and Marshall <br /> Brem. <br /> Mr. David Sanicki of Cape & Islands Engineering represented the Petition and stated that <br /> plans call to construct a pier, ramp and float and will be 70 feet in length from the MHW. <br /> Marshall Brem moves to grant the Special Permit. Robert Nelson seconds the motion. <br /> All agree. So moved. The Shellfish Constable and the Conservation Commission have <br /> approved the project. <br /> Robert D. Mancuso: Requests a Special Permit from Section 174-20 of the Zoning By- <br /> laws in order to demolish the existing dwelling and build a new dwelling on property <br /> located in an R-3 zoning district at 288 Shore Drive (Map 123 Parcel 188) Mashpee, MA. <br /> Sitting: Robert Nelson, James Regan, Zella Elizenberry, Marshall Brem and Richard <br /> Guerrera. <br /> Mr. Michael Aceto represented the petitioner at this hearing. There was some initial <br /> confusion regarding the need for a special permit since the petitioner was under the <br /> impression that they were in the Popponessett Overlay District which exempts them from <br /> needing a demolition permit. It was determined that their property lies outside the district <br /> and a demolition permit is necessary. The Board reviews the site plans with Mr. Aceto <br /> and they feel all documents are in order. Robert Nelson moves to grant the special <br /> permit. Marshall Brem seconds the motion. All agree. So moved. Reference plans from <br /> Christopher Costa& Associates, dated October 18, 2004. <br /> Other Business: <br /> Lori Corsi informs the Board that Attorney Jason Talerman has suggested that the Board <br /> recommend HAC as the monitoring agent for the McShane Chapter 40 B project.. The <br /> Board feels that whatever Mr. Talerman recommends is appropriate. A letter will be sent <br /> out to Ann Good at HAC stating the above recommendation. <br /> Marshall Brem makes a motion to adjourn. Robert Nelson seconds the motion. All <br /> agree.
