.:F <br /> ' Town of Mashpec <br /> 16 Great M�c k (&oad JV�)rd 1. <br /> '�y•..� 'tt >> <br /> _l�'1asl2p�c, ]Ylassach,usetts OCiJ <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision fora Variance <br /> RE: Claude Hardrick 205 Wheeler Road <br /> Map 49 Parcel 39 <br /> V-04-160 <br /> A Petition was filed on December 8, 2004 for a Variance from Section 174-31 of <br /> the Zoning By-laws for permission to vary the setback requirements to build a garage on <br /> property located in an R-5 zoning district at 205 Wheeler Road (Map 49 Parcel 39 ) <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on November 19, 2004 and <br /> Novvember 26, 2004, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, December 8, 2004, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Marshall Brem, Robert Nelson, <br /> James Regan, Zella Elizenberry and Richard Guerrera. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> David Hufilagel, the Builder represents petitioner at this hearing. They are <br /> seeking a variance from the setback requirements in order to build a garage. The Board <br /> reviews the plans and finds this to be a reasonable requests. The Board moves to grant <br /> the variance. <br /> GENERAL FINDINGS <br /> 1. that the subject property is at 205 Wheeler Road and contains 12,278 square <br /> feet. <br /> t <br />
