Town of Mashpce <br /> 16 Great _V�ck load JV)rth <br /> Mystipee, JWassachUSUtS 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Variance <br /> RE: Michael Sawicki 37 Deerfield Road <br /> Map 3 Parcel 54 <br /> V-04-163 <br /> A Petition was filed on November 10, 2004 for a Variance from Section 174-3)1 <br /> of the Zoning By-laws for permission to vary the setback requirements to expand their <br /> existing bedroom and add a bathroom on property located in an R-5 zoning district at 37 <br /> Deerfield Road (Map 3 Parcel 54 ) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on November 19, 2004 and <br /> Norvember 26, 2004, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, December 8, 2004, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Marshall Brem, Robert Nelson, <br /> James Regan, Zella Elizenberry and Richard GLierrera. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the To\vil of <br /> Mashpee Zoning By-laws. <br /> Mr. Sawicki represents himself at this hearing. He is seeking a variance to vary <br /> the setback requirements in order for him to expand their existing bedroom to add a <br /> sitting room and build a bathroom. This will not affect the number of bedrooms he has so <br /> the Board of Health has approved the project. Mr. Regan mentions that this dwelling <br /> predates the zoning that is in place noNv and feels the variance should be granted. All <br /> Paperwork is in order as the Board reviews the plot plans. The Board moves to grant the <br /> variances. <br />
