{Ut\ry <br /> Town of Mashpee <br /> 16 Great cVck Aoa(l�Ni)rlh, <br /> 1Xlaslrpee, A'lassachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Variance <br /> RE: Edward Kodinsky 85 Timberlane Drive <br /> Map 22 Block 24 <br /> V-04-165 <br /> A Petition was filed on November 4, 2004 for a Variance from Section 174-31 of <br /> the Zoning By-laws for permission to vary the setback requirements to allow <br /> for construction of a 24' a 24' addition to be used as a music room on property located in <br /> an R-3 zoning district at 85 Timerlane Drive (Map 22 Block 24) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise <br /> a newspaper of general circulation in the Town of Mashpee, on November 19, 2004 and <br /> November 26, 2004, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 12, 2005, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: James E. Regan III, Zella E. Elizenberry, <br /> Robert Nelson, Evano Cunha and Richard Guerrera. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the ToNvn of <br /> Mashpee Zoning By-laws. <br /> Thoms Rout, builder is representing petitioner in this matter. This matter was <br /> continued from December 8, 2004 so that petitioner could re-draw the plans to show the <br /> addition to be made larger. He is now building a 24' 1 24' addition that will be a music <br /> room and needs a sideline variance to do so. The Board reviews the plans and notes that <br /> the shape of the lot is makes is difficult to conform to the 15-foot setback requirement. <br /> Richard Guerrera moves to grant the variances to the petitioner. <br />
