r <br />0 <br />MR <br />`town of Mashpee <br />MASHPEE ZONING BOARD OF APPEALS 16 GreatNeck qtoad Xorth <br />Decision for a Variance Mashpee, Massachusetts 02649 <br />Carl Masteller <br />208 James Circle <br />Map 71 Parcel 25 <br />V-03-09 <br />A Petition was filed on December 17, 2002 for a Variance from Section 174-31 <br />of the Zoning By-laws for permission to vary .the frontage requirements and lot size <br />requirements under current zoning to deem this lot buildable. This property is located in <br />an R-3 zoning district at 208 James Circle (Map 71 Parcel 25) Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br />newspaper of general circulation in the Town of Mashpee, on December 27, 2002 and <br />January 3, 2003 a copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, January 8, 2003, at which time the following members of the Zoning Board <br />of Appeals were present and acting throughout: James Regan, Edward Govoni and <br />Robert Nelson. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br />Mashpee Zoning By-laws. <br />Carl Masteller represents himself. Petitioner owns both the lot in discussion as <br />well as the lot directly abutting this property with a home on it. The lot in question has <br />been taxed as a vacant buildable lot. Current zoning has rendered this lot as unbuildable <br />as such and Petitioner is seeking a 75 frontage Variance and a Variance of 28,219 square <br />feet to meet the current 40,000 square foot minimum requirement. The Board moves to <br />grant these Variances. <br />GENERAL FINDINGS <br />1. -that the subject lot is located at 208 James Circle and contains 11,781 square <br />feet. <br />
