Town of Mashpee <br />16 Great Xeck Pvoad Arth <br />Mashpee, Massachusetts 02649 <br />MASHPEE ZONING BOARD OF APPEALS <br />DECISION FOR A VARIANCE <br />Re: Joseph Marino 14 Ashumet Avenue <br />Map 49 Parcel 104 <br />V-03-08 <br />A Petition was filed on December 16, 2002 for a Variance under Section 174-31 <br />of the Zoning By-laws for permission to vary the required setbacks on the northwest side <br />in order to build a 24 x 34 garage on property located in an R-5 zoning district at 14 <br />Ashumet Avenue (Map 49 Parcel 104) Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br />newspaper of general circulation in the Town of Mashpee, on December 27, 2002 and <br />January 3, 2003, a copy of which is attached hereto and made a part hereof. <br />• A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, January 8, 2003, at which time the following members of the Zoning Board <br />of Appeals were present and acting throughout: Robert Nelson, Edward Govoni and <br />James Regan. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br />Mashpee Zoning By-laws. <br />Joseph Marino represented himself at this hearing. He is seeking an 8.6 foot <br />Variance on the northwest side in order to complete this proposed garage he was <br />originally permitted for in 1997. The Board moves to grant an 8.6 foot Variance on the <br />northwest side. <br />GENERAL FINDINGS <br />the property is located at 14 Ashumet Avenue and contains 11,250 square <br />• feet.. <br />
