Mashpee Zoning <br />Board of Appeals John J. Reardon Trust, <br />2 Quality Homes Realty Trust V-03-11 <br />Mr. John Slavinky of Cape & Islands Engineering represented the petitioner. <br />They are seeking a Variance to exceed the 70 foot total limit of a pier, ramp and float. <br />They are seeking a 101 foot Variance. The Board moves to grant this Variance. <br />GENERAL FINDINGS <br />1. that the subject property is located at 688 Great Neck Road, South and <br />contains 1.2 acres. <br />The Board determined that: <br />L the Petitioner met the criteria for grant of a Special Permit under Section <br />174-25.I.9. <br />2. the proposed construction will be an accessory to an existing dwelling. <br />3. the proposal has been approved by the Shellfish Constable whose <br />responsibilities include protection of the marine environment. <br />4. the proposal has been reviewed by the Conservation Commission to address <br />impacts on the coastal environment. <br />5. the use is in harmony with the general purpose and intent of the By-laws. <br />6. the owner has rights to maintenance in perpetuity. <br />7. filing with the State DEP Wetlands Program shall be considered execution of <br />the Special Permit. <br />In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br />Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br />made and seconded, the Zoning Board of Appeals voted unanimously on January 8, 2003 <br />to grant a Variance of 101 feet to allow, for the proposal on the subject property. <br />The Variance is conditioned upon compliance with plans of Cape & Islands Engineering <br />entitled `Proposed Pier Relocation, Located in Mashpee, Mass., File No. 768ACC, dated <br />December 11, 2002. <br />0 <br />
