Town of Mashpee <br />16 Great JVeck load Aorth <br />Amended Decision for a Variance <br />RE: Gloria and Mark Salgueiro ' <br />Mashpee, Massachusetts 02649 <br />110 Wheeler Road <br />Map 57 Parcel 20 <br />V-03-13 <br />A Petition was filed on December 23, 2002 for a Variance from Section 174-31 <br />of the Zoning By-laws for permission to vary .the frontage requirements and lot size <br />requirements under current zoning to deem this lot buildable. This property is located in <br />an R-5 zoning district at 110 Wheeler Road (Map 57 Parcel 20) Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br />newspaper of general circulation in the Town of Mashpee, on December 27, 2002 and <br />January 3, 2003 a copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, January 8, 2002, at which time the following members of the Zoning Board <br />of Appeals were present and acting throughout: Marshall Brem, Robert Nelson and Zella <br />Elizenbery. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br />Mashpee Zoning By-laws. <br />Attorney Robert Mills represented the petitioner. Petitioner owns both the lot in <br />discussion as well as the lot directly abutting this property with a home on it. The lot in <br />question has been taxed as a vacant buildable lot since 1947 with a valid Variance to <br />build. Current zoning has rendered this lot as unbuildable as such and Petitioner is <br />seeking a 50 frontage Variance and a Variance of 50,400 square feet to meet the current <br />80,000 square foot minimum requirement. The Board moves to grant these Variances. <br />GENERAL FINDINGS <br />that the subject lot is located at 110 Wheeler Road and contains 29,600 square <br />feet.�� <br />44, <br />nZ�4J <br />T <br />
