Mashpee Zoning <br />Board of Appeal Ralph and Susan Cook SP -03-05 <br />2 <br />SPECIAL PERMIT CRITERIA <br />Section 174-17 of the Mashpee Zoning By-laws and Massachusetts General <br />Laws Chapter 40A, Chapter 6, require a finding that the extension, alteration or change <br />shall not be substantially more detrimental to the neighborhood than the existing <br />non -conforming use. <br />SPECIFIC FINDINGS <br />1. is consistent with applicable state and town regulations, statutes, bylaws and <br />In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br />applicant met the criteria necessary for the granting of a Special Permit. Upon motion <br />duly made and seconded, the Zoning Board of Appeals voted unanimously on January 8, <br />2003 to grant the Special Permit conditioned on compliance with Architectural Plans <br />from Terry Luff, Architect, 832 Main Street, Osterville, dated November 7, 2002, and <br />engineering plans from Cape & Islands Engineering, dated December 9, 2002, File No. <br />9 154 MA. <br />plans. <br />2. <br />will not adversely affect public health or safety. <br />3. <br />will not cause excessive demand on community facilities. <br />4. <br />will not significantly decrease surface or groundwater quality or air quality. <br />5. <br />will not have a significant adverse impact on wildlife habitat, estuarine <br />systems, traffic flow, traffic safety, waterways, fisheries, public lands or <br />neighboring properties. <br />• 6. <br />will not produce amounts of trash, refuse or debris in excess of the town's <br />landfill disposal <br />and waste capacities. <br />7. <br />will properly dispose of stumps, construction debris, hazardous materials and <br />other waste. <br />8. <br />will provide adequate off-street parking. <br />9. <br />will not cause excessive erosion or cause increased runoff onto neighboring <br />properties or into any natural river, stream, pond or water body and will not <br />otherwise be detrimental to the town or the area. <br />In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br />applicant met the criteria necessary for the granting of a Special Permit.
