Town of Nashpee <br />orth <br />MASHPEE ZONING BOARD OF APPEA Great sack load 0 <br />shpee, Massachusetts 026492649 <br />DECISION FOR A VARIANCE <br />RE: Kurt and Cathy Murray <br />40 County Road <br />Map 71 Parcel 138 <br />V-03-18 <br />A Petition was filed on January 3, 2003 by Kurt and Cathy Murray for a Variance <br />from Sections 174-31 and 174-21 of the Zoning By-laws for permission to vary the front <br />setbacks, lot size requirements and frontage relief in order expand their existing house on <br />property located in an R-5 zoning district at 40 County Road (Map 71 Parcel 138) <br />Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br />a newspaper of general circulation in the Town of Mashpee, on January 10, 2003 and <br />January 17, 2003, a copy of which is attached hereto and made a part hereof. <br />• A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, January 22, 3003 at which time the following members of the Zoning Board <br />of Appeals were present and acting throughout: James Regan, III, Richard Guerrera and <br />Zella Elizenberry. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br />Mashpee Zoning By-laws. <br />David Sanicki of Cape & Islands Engineering represents the petitioner. They are <br />seeking relief for the front yard setbacks, frontage relief and lot size relief in order to <br />expand their house with a 22 x 22 addition. The Board granted the following Variances: <br />❑ A Variance of 9.2 on Dixon Drive <br />❑ A Variance of 4.8 feet for frontage relief <br />❑ A Variance of 63,005 square feet for lot size <br />0 <br />
