Map 55 Parcel 24 and <br />23 (a portion thereof) <br />SP -03-15 <br />A Petition was filed on December 23, 2002 by Davenport Realty Trust, for a <br />Special Permit under Section 174-25(E)(1) and (E)(8) and H(6) of the Zoning By-laws <br />for the sale of retail fence products consisting but not limited to mailbox posts, lamp <br />posts, arbors, etc. and to allow a one -bedroom apartment on the second floor for an onsite <br />security person on property located in a C -2/R-3 zoning district at 18 Falmouth Road <br />(Map 55 Parcels 24 and a portion of 23) Mashpee, MA. <br />• Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br />newspaper of general circulation in the Town of Mashpee, on December 27, 2003 and <br />January 3, 2003, a copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, January 8, 2003, continued to March 12, 2003 and April 9, 2003 at which <br />time the following members of the Zoning Board of Appeals were present and acting <br />throughout: James Regan, Marshall Brem and Robert Nelson. <br />Attorney Robert Mills is present and represents Petitioner Davenport Realty <br />Trust. Mr. David Bisbee, Vice President of Davenport Realty Trust, Mr. Jack Landers- <br />Cauley, Engineer, and Mr. Rick Bates, Principal of Cape Cod Fence are also present and <br />will be the tenants of this property. Mr. Mills explains that the first floor would be used <br />for storage of materials and some modest assembly of fences and gates. applicant <br />• proposes to build a 3,190 square foot building for the operation of Cape Cod Fence <br />
