• <br />• <br />0 <br />Mashpee Zoning <br />Board of Appeals <br />2 <br />GENERAL FINDINGS <br />Michael Sliwa <br />V-03-21 <br />1. that the subject property is located at 94 Redbrook Road and contains 24,513 <br />square feet. <br />SPECIFIC FINDINGS <br />The Board determined that: <br />1. a literal enforcement of the By-laws would involve hardship to the Petitioner. <br />2. the proposal would be an improvement to the subject lot and to the <br />neighborhood; therefore, relief may be granted without detriment to the public <br />good and without derogating from the intent or purpose of the By-laws. <br />3. installation of a new septic system would be an improvement to the subject <br />property; therefore, relief may be granted without detriment to the public <br />good. <br />In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br />Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br />made and seconded, the Zoning Board of Appeals voted unanimously on February 26, <br />2003 to grant a 3.3 foot Variance on the sideyard and 15,487 square feet on the land <br />space requirements. These variances are conditioned on plans from Cape & Islands <br />Engineering, Plan No. 013003, File No. 242 MA, Septic File No. 72, dated January 30, <br />2003. <br />
