L <br />Town of Mashpee <br />MASHPEE ZONING BOARD OF APPEALS 16 Great Xeck q�qad JVorth <br />Mashpee, Massachusetts 02649 <br />Decision for a Variance <br />RE: Stephen Curtin <br />39 Fox Hill Road <br />Map 21 Parcel 59 <br />V-03-38 <br />A Petition was filed on February 25, 2003 by Stephen Curtin for a Variance from <br />Section 174-31 of the Zoning By-laws for permission to vary sideline and rear setback <br />requirements to allow for the installation of a 32' x 16' in -ground swimming pool on <br />property located in an R-5 zoning district at 39 Fox Hill Road (Map 21 Parcel 59) <br />Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br />newspaper of general circulation in the Town of Mashpee, on February 28, 2003 and <br />March 7, 2003, a copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />• Wednesday, March 12, 2003, at which time the following members of the Zoning Board <br />of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry and <br />James Regan. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br />Mashpee Zoning By-laws. <br />Mr. Stephen Curtin is requesting a Variance in order to install a 16' x 32' in <br />ground swimming pool. He needs a 10 -foot Variance on the northerly side and a 20 -foot <br />Variance in the rear. The Board requests a new site plan from an engineer showing the <br />proposed pool with the on the property. Mr. Curtin agrees to provide these plans. The <br />Board moves to grant these Variances. <br />GENERAL FINDINGS <br />1. that the subject property is located at 39 Fox Hill Road and contains 17,144 <br />0 square feet. <br />
