Town of Mashpee <br />MASHPEE ZONING BOARD OF APPEAL 16 Great JVeck Pvoad Aorth <br />ashpee, Massachusetts 02649 <br />RE: Anthony Shuman and <br />Dorothy Kagan <br />Decision for a Variance <br />29 Pickerel Cove <br />Map 14 Parcel 5 <br />V-03-40 <br />A Petition was filed on February 25, 2003 by Anthony Shuman and Dorothy <br />Kagan for a Variance from Sections 174-21, 174-31 and 174-32 of the Zoning By-laws to <br />seek relief from land space requirements, frontage relief and road access to have this lot <br />deemed buildable on property located in an R-5 zoning district at 29 Pickerel Cove (Map <br />14 Block 5) Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br />newspaper of general circulation in the Town of Mashpee, on February 28, 2003 and <br />March 7, 2003, a copy of which is attached hereto and made a part hereof. <br />• <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, May 14, 2003 and continued to June 11, 2003, at which time the following <br />members of the Zoning Board of Appeals were present and acting throughout: Edward <br />M. Govoni, Robert G. Nelson and Marshall Brem. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br />Mashpee Zoning By-laws. <br />John Slavinsky of Cape & Islands Engineering represent the petitioners. Mr. <br />Kagan and Mr. Shuman purchased this property in 1955. In 1956, the Town subdivided <br />it into 18 lots on the water (except one). In 1961, a slight change was made to lot #6; it <br />was made into 2 smaller lots, which were sold to Gottlieb in 1961. When Mr. Kagan <br />marketed these lots, it was done so with the idea that this was the way it was going to be <br />• <br />
