Town of Mashpee <br />16 Great Xeck Pvoad Xorth <br />Mashpee, Massachusetts 02649 <br />MASHPEE ZONING BOARD OF APPEALS <br />Decision for a Variance <br />Mashpee Commons 38 Nathan Ellis Highway <br />Limited Partnership V-03-32 Map 74 Block 20 <br />V-03-32 <br />A Petition was filed on February 10, 2003 by Mashpee Commons Limited <br />Partnership for a Variance from Sections 174-28, 174-30, 174-31 and 174-45.I of the <br />Zoning By-laws for permission to vary the setback requirement between structures, <br />namely building numbers 12 and 16 and for a 45 foot variance on height requirements for <br />a proposed 3 story structure (Building 16) on property located in a C-1 zoning district at <br />38 Nathan Ellis Highway (Map 74 Block 20) Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />• Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br />newspaper of general circulation in the Town of Mashpee, February 28, 2003 and March <br />7, 2003, a copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, March 12, 2003 and continued to April 9, 2003 at which time the following <br />members of the Zoning Board of Appeals were present and acting throughout: Robert <br />Nelson, James Regan and Zella Elizenberry. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br />Mashpee Zoning By-laws. <br />Mr. Douglas Storrs, Vice President of Mashpee Commons Limited Partnership, <br />represented the application. The applicant is seeking a Variance <br />No comments were received from abutters. <br />GENERAL FINDINGS <br />1. that the subject property is located at 38 Nathan Ellis Highway and consists of <br />• 40.3 acres of land. <br />
