0 <br />• <br />9 <br />Mashpee Zoning Henry and Elizabeth Spohr 2 <br />Board of Appeals SP -03-43 <br />342 and 352 Monomoscoy Road <br />there are no houses on these lots and one needs a dwelling to have an accessory structure. <br />Mr. Sanick proposes to allow these special permits so they he can pursue the licensing <br />matter which takes up to one year to complete. Mr. Govoni states that these permits, if <br />granted, will be strictly conditioned. The Board decides the permit will be conditioned <br />on the following: "there must be a building permit issued and the structure must be <br />complete with an occupancy permit issued before the dock can be built." The Board <br />moves to grant the Special Permit. <br />project. <br />The Conservation Commission and the Shellfish Constable have approved the <br />No comments were received from abutters. <br />GENERAL FINDINGS <br />1. that the subject property is located at 342 and 352 Monomoscoy Road and <br />contains (342 Monomoscoy Road contains 51,200 square feet and 352 <br />Monomoscoy Road contains 52,100 square feet.) <br />SPECIAL PERMIT CRITERIA <br />Section 174-25.I.9 states that the Board must find that the structure will not <br />unduly interfere with the free passage of travel by water or land or cause or contribute <br />to the substantial disruption or degradation of the marine or coastal environment. <br />SPECIFIC FINDINGS <br />1. that the proposed dock cannot be built until an occupancy permit has been <br />issued for the proposed dwelling on said property. <br />2. that the Shellfish Constable, whose responsibilities include protection of the <br />marine environment, has approved the proposal. <br />3. that the proposal has been reviewed by the Conservation Commission to <br />address impacts on the coastal environment. <br />4. that the use is in harmony with the general purpose and intent of the By-laws. <br />5. that the owner has rights to maintenance in perpetuity. <br />
