mk <br />Town of Mashpee <br />Decision for a Variance <br />Carl Masteller <br />Mashpee, Massachusetts 02649 <br />202 James Circle <br />Map 71 Parcel 24 <br />V-03-42 <br />A Petition was filed on February 28, 2003 for a Variance from Section 174-31 of <br />the Zoning By-laws for permission to vary the sideline setback requirements under <br />current zoning to legalize existing attached structures built in approximately 1988. The <br />statute of limitations is ten years and will apply to the 12.8 foot Variance on the <br />northeasterly side and a 19 foot Variance on the garage side of the property. This <br />property is located in an R-3 zoning district at 202 James Circle (Map 71 Parcel 24) <br />Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br />newspaper of general circulation in the Town of Mashpee, on March 14, 2003 and March <br />is <br />21, 2003, a copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, March 26, 2003, at which time the following members of the Zoning Board <br />of Appeals were present and acting throughout: James Regan, Marshall Brem and Robert <br />Nelson. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br />Mashpee Zoning By-laws. <br />Robin Masteller represented she and her husband. They are seeking to rectify a <br />situation that was done in 1988. The existing house at 202 James Circle had two <br />additions put on that now, under current zoning, necessitate a Variance. Due to the <br />statute of limitations, the Board moved to grant a 12.8 foot Variance on the northeasterly <br />side and a 19 foot Variance on the garage side. <br />0 <br />
