He was informed by the Building <br /> Inspector Russ wheeler that this lot was unbuildable due to contiguous ownership. The <br /> Board reviewed the status of the lot and felt that as long as the proposed dwelling was <br /> contained to a one bedroom house as the Board of Health has requested, it could be built <br /> upon. The Board moved to grant a 40 foot frontage variance and a 68,784 square foot <br /> land space variance. Motion is seconded. All agree. So moved. <br /> M r ret Fit ibb n: Requests a Special Permit from Section 174-25.A.8 of the <br /> Zoning By-laves to construct an accessory structure in-lav apartment) on property <br /> located in an R-3 zoning district at 701 Great Neck Road, South Map 104 Parcel 125) <br /> Mashpee, IIIA. <br /> Sitting: Robert Nelson, Marshall Brem and Richard Guerrera. Edward Govoni steps <br /> down from this hearing. <br /> Margaret Fitzgibbon represented herself at this hearing. She is seeking a Special Permit <br /> to finish a detached accessory structure for an in-law apartment. She has replaced the old <br /> barn on the property with a three car garage with a room over and has kept the antique <br /> look that was an historical house at one time. She has one acre of property and is cleared <br /> with the Board of Health, however, due to the fact that the dwelling in question is <br /> detached it presents a problem with zoning and allowing two separate dwellings on one <br /> property. The Board and petitioner discuss at length some of the alternative that could b <br /> done. The Board feels that the dwellings must be connected somehow. They move to <br /> continue the matter to June 2 , 2003 for the petitioner to bring in a couple of new ideas. <br /> Motion is seconded. All agree. So moved. <br /> David H. Webb: Requests a variance from Section 174-31 of the Zoning By-laws to <br /> vary the setback requirements in order to build a ' x 11' screened porch on property <br /> located in an R-3 zoning district at 43 Tide Run (Map 126 Parol 7) Mashpee, MA. <br /> Owner of Record: Levis Rubin <br /> Sitting: Robert Nelson, James Regan and Edward Govoni. <br /> David Webb, Builder for the petitioner, represents him at the hearing. They are seeking a <br /> variance in order to build a screened in porch. The lot goes off unevenly on one side and <br /> they only need 1.9 feet to complete this project. The Board moves to grant the variance. <br /> Motion is seconded. All agree. So moved. <br /> The Board makes a notion to accept the minutes from the hearing on May 28, 2003. <br /> The motion is seconded. All agree. So moved. <br /> The Board Secretary discusses a litigation matter Raleigh v.
