Town ofMashpee 16 Great Jlreck load Jdorth TABU MASHPEE ZONING BOARD OF APPEALe'hpee, Vassachusetts 02649 Decision for a Special Permit RE: Armine Sabatini 6 Kelly Road Map 78 Parcel 88 SP-03-93 A Petition was filed on June 9, 2003 by Armine Sabatini for a Special Permit under Section 174-25.A.8 of the Zoning By-laws to build an accessory structure to the existing dwelling on property located in an R-3 zoning district at 6 Kelly Road (Map 78 Parcel 88) Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, June 13, 2003 and June 20, 2003, a copy of which is attached hereto and made a part hereof. A Public Hearing was held on the Petition at the Mashpee Town Hall on • Wednesday, September 10, 2003 at which time the following members of the Zoning Board of Appeals were present and acting throughout: Marshall Brem, Zella Elizenberry and Richard Guerrera. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of Mashpee Zoning By-laws. Richard and Armine Sabatini represent themselves at this continued hearing. Mr. Sabatini was before the Board on June 25, 2003 seeking a Special Permit for an accessory structure. The Board felt the drawings presented at that time were not sufficient to render a decision. They asked Mr. Sabatini to have new drawings rendered and come back to the Board. Mr. Sabatini presented the new drawings to the Board and the Board felt satisfied with this plan. Ms. Elizenberry asked Mr. Sabatini if it will be owner occupied and he said that it would be. The matter is approved by the Board of Health. Mr. Brem moved to grant the Special Permit. Ms. Elizenberry seconded the motion. •
