{ <br /> Town of Mashpee <br /> 3 <br /> V 16 Great Xeck Xoad JVorth <br /> MASHPEE ZONING BOARD OF APPEA&shpee, Massachusetts 02649 <br /> Decision for a Variance <br /> RE: Paul Dardano 23 Pine Avenue <br /> Map 123 Parcel 24 <br /> V-03-95 <br /> A Petition was filed on June 9, 2003 by Paul Dardano for a Variance from Section <br /> 174-31 of the Zoning By-laws for permission to vary the setback requirements and lot <br /> coverage requirements to allow for a 28' x 42' house to be built on property located in an <br /> R-3 zoning district at 23 Pine Avenue (Map 123 Parcel 24) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on June 13, 2003 and June 20, <br /> 2003, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 25, 2003, at which time the following members of the Zoning Board of <br /> • Appeals were present and acting throughout: Edward Govoni, Zella Elizenberry and <br /> Robert Nelson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> John Slavinsky of Cape and Islands Engineering represents the petitioner. Mr. <br /> Paul Dardano is also present. They are seeking Variance relief from the current zoning <br /> setback requirements as well as relief from lot coverage requirements in order to build a <br /> 28' x 42' new house. There are 6 letters in support from direct abutters of Mr. Dardano's <br /> proposal. There will be a new septic system installed and the new house is equal in size <br /> to the other neighboring houses. The Board moves to grant the Variance and lot coverage <br /> relief. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 23 Pine Avenue and contains 5,500 <br /> square feet. <br />
