Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on August 8, 2003 and August <br /> 15, 2003, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 10, 2003, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry <br /> and James Regan. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Kevin Kirrane represents Robert Maffei and John Maffei (Patriot <br /> Development LLC) in this hearing. John Slavinski of Cape & Islands is also present for <br /> any engineering questions the Board may have. Mr. Kirrane informs the Board that his <br /> clients are seeking a Special Permit in order to construct and use the premises as a <br /> wholesale landscape business to include the storage of materials and equipment (indoor <br /> and out) used in connection with such wholesale business on Nicoletta's Way. The <br /> parcel is an undeveloped piece of woodland containing 106,503 square feet with 400 feet <br /> of frontage. The parcel is primarily located in the I-1 zoning district but also contains <br /> square footage in the C-3 zoning district as well. Other than some parking to be utilized <br /> in connection with the use, the building and storage uses are situated wholly within the I- <br /> • 1 zoning district.
