Town of Mashpee <br /> 16 Great Aeck &ad JVorth <br /> ABUNie / Decision for a Variance Mashpee, Massachusetts 02649 <br /> RE: Roger Medeiros 52 Lowell Road. <br /> Map 52 Parcel 36 <br /> V-03-114 <br /> A Petition was filed on August 15, 2003 for a Variance from Section 174-31 of <br /> the Zoning By-laws for permission to vary the lot size requirements under current zoning <br /> to deem this lot buildable. This property is located in an R-5 zoning district at 52 Lowell <br /> Road (Map 52 Parcel 36) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on August 22, 2003 and <br /> August 29, 2003, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 10, 2003, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James Regan, Zella Elizenberry <br /> • and Marshall Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Roger Medeiros represented himself at this hearing. He is seeking relief from the <br /> current zoning which is hindering his lot from being deemed buildable. His lot has been <br /> assessed and taxed as a buildable lot. All tax bills are in order. Mr. Brem moves to grant <br /> the Variance. Mr. Regan seconds the motion. <br /> GENERAL FINDINGS <br /> 1. that the subject lot is located at 52 Lowell Road and contains 11, 953 square <br /> feet. <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> • that there are circumstances relating to the shape and topography which affect this lot and <br />
