Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on August 22, 2003 and <br /> August 29, 2003 a copy of which is attached hereto and made a part hereof. <br /> • A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 10, 2003 at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry <br /> and Richard Guerrera. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Chance Reichel represents himself at this hearing. He has an existing shed that <br /> will require a variance. The shed is currently 5 feet off the lot. Mr. Nelson notes that the <br /> distance is not determined on the plot plan and needs to be done. The Board discusses <br /> the variance and decides to grant the 10-foot variance pending Cape and Islands re-draw <br /> of the distance on the plans. Richard Guerrera moves to grant the 10-foot variance. Zella <br /> Elizenberry seconds the motion. <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> • that there are circumstances relating to the shape and topography which affect this lot and <br />
