Aleman 12 Pondview Ave. <br /> Map 58 Parcel 73 <br /> V-03-113 <br /> A Petition was filed on August 7, 2003 for a Variance from Section 174-31 of the <br /> Zoning By-laws for permission to vary the frontage requirements and lot size <br /> requirements under current zoning to deem this lot buildable. This property is located in <br /> an R-5 zoning district at 12 Pondview Avenue (Map 58 Parcel 73) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on August 22, 2003 and <br /> August 29, 2003, a copy of which is attached hereto and made a part hereof. <br /> • A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 10, 2003, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenber y <br /> and Marshall Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Marta Aleman represented herself at this hearing. She is seeking Variance relief <br /> in order to have this lot deemed buildable. She has owned this lot since 1973 and it is <br /> assessed and taxed as a buildable lot. The current zoning is impacting her ability to <br /> obtain a building permit to build on this lot. The Board reviews her tax bills and finds all <br /> things to be in order. Mr. Brem moves to grant the variances to this lot. Zella <br /> Elizenberry seconds the motion. <br /> • <br />
