Mashpee, Massachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Special Permit <br /> RE: Irwin Shaw 5 Sunset Circle <br /> Map 64 Parcel 35 <br /> SP-03-124 <br /> A Petition was filed on August 25, 2003 by Irwin Shaw for a Special Permit from <br /> Section 174-25.1.9 of the Zoning By-laws in order to construct, license and maintain a <br /> pier, ramp and float on property located in an R-5 zoning district at 5 Sunset Circle (Map <br /> 64 Parcel 35) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on September 12, 2003, and <br /> September 19, 2003, a copy of which is attached hereto and made a part hereof. <br /> • A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 24, 2003, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James Regan, Robert Nelson and <br /> Richard Guerrera. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> David Sanicki of Cape & Islands Engineering represents the petitioner in this <br /> matter. Mr. Shaw would like approval for a pier, ramp and float. Conservation has <br /> approved the matter. The Board discusses the fact that this is a vacant lot. Mr. Sanicki <br /> informs the Board that he just wants the approval so that he can move forward with the <br /> lengthy licensing procedure. The Board moves to grant the Special Permit with the <br /> condition that the house be under construction before the dock goes in. Mr. Guerrera <br /> moves to grant the Special Permit. Robert Nelson seconds the motion. <br /> • <br />
