Mashpee, Massachusetts 02649 MASHPEE ZONING BOARD OF APPEALS Decision for a Special Permit RE: Irwin Shaw 5 Sunset Circle Map 64 Parcel 35 SP-03-124 A Petition was filed on August 25, 2003 by Irwin Shaw for a Special Permit from Section 174-25.1.9 of the Zoning By-laws in order to construct, license and maintain a pier, ramp and float on property located in an R-5 zoning district at 5 Sunset Circle (Map 64 Parcel 35) Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on September 12, 2003, and September 19, 2003, a copy of which is attached hereto and made a part hereof. • A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, September 24, 2003, at which time the following members of the Zoning Board of Appeals were present and acting throughout: James Regan, Robert Nelson and Richard Guerrera. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of Mashpee Zoning By-laws. David Sanicki of Cape & Islands Engineering represents the petitioner in this matter. Mr. Shaw would like approval for a pier, ramp and float. Conservation has approved the matter. The Board discusses the fact that this is a vacant lot. Mr. Sanicki informs the Board that he just wants the approval so that he can move forward with the lengthy licensing procedure. The Board moves to grant the Special Permit with the condition that the house be under construction before the dock goes in. Mr. Guerrera moves to grant the Special Permit. Robert Nelson seconds the motion. •
