Town of Mashpee <br /> 3 <br /> 16 Great deck load JVorth <br /> �awE x* <br /> MASHPEE ZONING BOARD OF APPEALashpec' Massachusetts 02649 <br /> Decision for a Variance <br /> RE: Edward Keelan 4 Keelan Way <br /> c/o Allan Clapp Map 112 Parcel 46 <br /> V-03-130 <br /> A Petition was filed on September 3, 2003 by Edward Keelan for a Variance from <br /> Section 174-32of the Zoning By-laws seeking relief from the fire protection code to have <br /> a crushed stone access roadway in order to build a house and deck on property located in <br /> an R-3 zoning district at 4 Keelan Way (Map 112 Parcel 46) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on September 12, 2003 and <br /> September 19, 2003, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> • Wednesday, September 24, 2003, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, James Regan and <br /> Marshall Brent. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> David Sanicki of Cape &Islands Engineering represents Mr. Keelan in this <br /> matter. They are seeking relief from the fire protection law due to the fact that the <br /> farthest point is from the dwelling is 150 feet from pavement for the fire trucks. They <br /> would like to put in crushed stone driveways to access the house. Conservation has <br /> approved this project. Petitioner is seeking an 12-foot variance. Marshall Brem moves to <br /> grant the requested variances. Mr. Nelson seconds the motion. <br /> The Board would like petitioner to speak with the Planning Board as well. <br /> is <br />
