Town of Nashpee <br /> 16 Great JVeck load JVorth <br /> Mashpee, Massachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Special Permit <br /> RE: Horace Sylvester 2 Great River Road <br /> Map 120 Parcel 191 <br /> SP-03-127 <br /> A Petition was filed on August 25, 2003 by Horace Sylvester of Hingham, <br /> Massachusetts for a Special Permit from Section 174-25.I.9 of the Zoning By-laws in <br /> order to upgrade and maintain a pier, ramp and float on property located in an R-3 zoning <br /> district at 2 Great River Road (Map 120 Parcel 19 1) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on September 12, 2003, and <br /> September 19, 2003, a copy of which is attached hereto and made a part hereof. <br /> • A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 24, 2003, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James Regan, Robert Nelson and <br /> Richard Guerrera. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Horace Sylvester represents himself at this hearing. He is seeking to build a <br /> pier, ramp and float on Great River. He has a 10A float that exists and needs to replace <br /> the existing posts. Things are shifting and he would like to upgrade it. Conservation has <br /> approved the project. Richard Guerrera moves to grant the Special Permit. Robert <br /> Nelson seconds the motion. <br /> SPECIAL PERMIT CRITERIA <br /> Section 174-25.L9 states that the Board must find that the structure will not <br /> unduly interfere with the free passage of travel by water or land or cause or contribute <br /> • to the substantial disruption or degradation of the marine or coastal environment. <br />
