Town of Alashpee <br /> 3 <br /> 16 Great JVeck Pvoad Xorth <br /> 'deme cam^ Mashpee, Massachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Amended Decision for a Variance <br /> RE: Peter and Dianne Capodilupo 107 Shore Drive <br /> Map 117 Parcel 336 <br /> V-03-116 <br /> A Petition was filed on August 18, 2003 by Peter and Dianne Capodilupo for a <br /> Variance from Section 174-31of the Zoning By-laws for permission to vary the setback <br /> requirements in order to rebuild a house on property located in an R-3 zoning district at <br /> 107 Shore Drive (Map 117 Parcel 336) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on August 22, 2003 and <br /> August 29, 2003, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 10, 2003 and September 24, 2003, at which time the following <br /> members of the Zoning Board of Appeals were present and acting throughout: James <br /> Regan, Robert Nelson and Richard Guerrera. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Carl MacDonald represents his clients the Capodilupo's for this hearing. They <br /> are seeking to demolish a pre-existing non conforming structure and rebuild a house <br /> using the same footprint. They are seeking relief from the setback requirements. Mr. <br /> MacDonald informs the Board that although he is going to rebuild within the same <br /> footprint, the current zoning will require setback relief. Mr. MacDonald explains what <br /> his clients would like to do to the Board. The Board discusses the pre-existing condition <br /> and the requested variances.
