Clarke Hill, Heather Hill 50 Popponesset Island Road <br /> Map 106 Parcel 24 <br /> SP-03-128 <br /> A Petition was filed on August 21, 2003 by L. Clark Hill and Heather Hill to <br /> modify the Special Permit (SP-98-01) granted by the Board of Appeals in order to <br /> construct/relocate an existing boathouse/accessory structure building to 15-feet from the <br /> existing sideline. The Board has determined that the structure currently in the process of <br /> being attached to the main dwelling is not substantially more detrimental to the <br /> neighborhood and will be done on property located in an R-3 zoning district at 50 <br /> Popponesset Island Road (Map 106 Parcel 24) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> • newspaper of general circulation in the Town of Mashpee, on August 9 and August 16, <br /> 2002, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, October 22, 2003 at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: James Regan, Marshall Brem and Robert <br /> Nelson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A and the Town of Mashpee <br /> Zoning By-laws <br /> Attorney Kevin Kirrane represents the Hills at this hearing. After appearing <br /> before this Board several times on this matter which is currently being appealed, Mr. <br /> Kirrane informs the Board that his client will concede to move the accessory dwelling at <br /> issue to the 15-foot setback mark and attach it to the main dwelling.
