house. The plaintiffs reviewed the Hills' application and related <br /> • materials. The footprint of the new house�is approximately twice the <br /> size of the prior existing nonconforming structure. The plans for the <br /> proposed construction showed one structure only. The proposed new <br /> dwelling was to be set back about 37 feet from the plaintiffs' lot line. <br /> In consideration of the set 37 foot set back, the plaintiffs voiced no <br /> opposition to the Hills' application for a special permit. <br /> 11. In granting the Hills' application for a special permit in 1998, the Board <br /> found that "the proposed structure, its location on the lot and the <br /> intendeduse comply with the general provisions set forth within the <br /> By-laws" and complies with the current setback requirements. The <br /> Board specifically found that the proposed structure would not <br /> increase the non-conforming nature of the structure. The Board <br /> imposed the condition that the house be built in compliance with the <br /> plans submitted to the Board. <br /> 12. The Hills' new house has four bedrooms, four bathrooms and a total of <br /> nine rooms. <br /> 13. The subject properties are located on the shores of Popponesset Bay, <br /> which is a regulated wetland. In 2001, as a prerequisite to obtaining <br /> approval to build an additional structure described as a "boathouse", <br /> the Hills filed an application with the Town of Mashpee Conservation <br /> Commission. The "boathouse" is the subject-of the instant appeal and <br /> the prior appeal to this court. The plaintiffs received notice of the <br /> proceedings. In response to the Hills' application, plaintiffs wrote a <br /> letter which placed the Town of Mashpee on notice that the proposed <br /> structure violated both the requirements of the 15 foot side yard set <br /> • back and the requirement of maintaining at least 20 feet between <br /> 3 <br />
