Town of Mashpee <br /> 16 Great Vec)- Pvoad North <br /> Mashpee, Alassachusetts 02649 <br /> • MASHPEE ZONING BOARD OF APPEALS P <br /> Decision for a Variance <br /> RE: Louis and Louise Dimeo 75 Popponesset Island Road <br /> Map 106 Parcel 8 <br /> V-03-134 <br /> A Petition was filed on September 15, 2003 for a Variance from Section 174-31 <br /> of the Zoning By-laws to vary the current setback requirements in order install a <br /> swimming pool and cabana on property located in an R-3 zoning district at 75 <br /> Popponesset Island Road (Map 106 Block 8) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation on September 26, 2003 and October 3, 2003 a copy of <br /> which is attached hereto and made a part in the Town of Mashpee, on hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, <br /> December 10, 2003 at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Robert Nelson, James Regan and Zella <br /> Elizenberry. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Norman Hayes of the BSC Group,Norwell, MA represents the petitioner at this <br /> hearing. They are seeking a 25 foot variance from the front-yard setback requirements <br /> for a swimming pool and cabana. The frontyard setback requirement is 40 feet. Mr. <br /> Hayes reviews plans with the board. The Board moves to grant a 25-foot variance from <br /> the frontyard on Trailway. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 75 Popponesset Island Road and <br /> . contains 16,988 square feet. <br />
