Town of Mashpee <br /> h i <br /> 16 Great JVeck Pvoad JVorth <br /> Mashpee, Massachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Variance <br /> RE: Barbara and Walter Phillips 32 Sunset Circle <br /> Map 64 Parcel 17 <br /> V-03-141 <br /> A Petition was filed on October 1, 2003 for a Variance from Section 174-31 of the <br /> Zoning By-laws to vary the current setback requirements in order build a shed on <br /> property located in an R-5 zoning district at 32 Sunset Circle (Map 164 Block 17) <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation on October 10, 2003 and October 17, 2003 a copy of <br /> which is attached hereto and made a part in the Town of Mashpee, on hereof. <br /> . A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, <br /> October 22, 2003 at which time the following members of the Zoning Board of Appeals <br /> were present and acting throughout: Robert Nelson, James Regan and Marshall Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Walter and Barbara Phillips represent themselves at this hearing. They are seeking a <br /> 20 foot variance in order to install a l Ox 12 shed. Michael Ronhock of 89 Sunset Circle, <br /> a direct abutter, is in full support of this shed. When the lots were originally created, <br /> there was a 10 foot buffer line. In addition, the house is situated on the lot so that it <br /> creates no alternative where to put the shed. Robert Nelson moves to grant the variance. <br /> Marshall Brem seconds the motion. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 32 Sunset Circle and contains 16,800 <br /> square feet. <br />
