I <br /> uy Town of Mashpee <br /> 16 Great JVeck Pvoad Arth <br /> ee, ATassachusetts 02649 ash <br /> MASHPEE ZONING BOARD OF APPEALS P <br /> DECISION FOR A VARIANCE <br /> Re: Christopher Johnson 29 Christopher Lane <br /> 33 Christopher Lane <br /> 37 Christopher Lane <br /> 32 Christopher Lane <br /> 26 Christopher Lane <br /> 18 Christopher Lane <br /> Map 69 Parcels 98A, 97B, <br /> 87, 88, 89 and 100 <br /> V—03-137 <br /> A Petition was filed on September 24, 2003 for a Variance under Section 174-26 <br /> of the Zoning By-laws for permission to seek relief from the growth control requirement <br /> for 6 tots in the subdivision plan noted to obtain a building permits on property located in <br /> an R-3 zoning district at (Map 69 Parcels 98A, 97B, 87, 88, 89 and 100) Mashpee, MA. <br /> • Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on October 10, 2003 and <br /> October 17, 2003 a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, October 22, 2003, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James Regan, Zella Elizenbeny <br /> and Richard Guerrera. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Christopher Johnson represents himself at this hearing. He is in the process of <br /> developing a sub-division and has 6 lots he wants to build on. He is seeking a variance <br /> from the growth management by-law whereby only one building permit is given per year. <br /> Russell Wheeler, Building Inspector feels giving Mr. Johnson 3 permits in 2003 and <br /> • Z5 Z g <br />
