i <br /> Town of Mashpee <br /> N � 16 Creat JVeck Xoad Arth <br /> ABU Alashpee, Massachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Variance <br /> RE: Gerald Fine 12 Summer Sea <br /> Map 104 Parcel 94 <br /> V-03-142 <br /> A Petition was filed on October 7, 2003 by Thomas O' Hara, Builder for Gerald <br /> Fine, for a Variance from Section 174-31 of the Zoning By-laws to vary the current <br /> setback requirements in order to build a deck on property located in an R-3 zoning <br /> district at 12 Summer Sea (Map 104 Block 94) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation on October 10, 2003 and October 17, 2003 a copy of <br /> which is attached hereto and made a part in the Town of Mashpee, on hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, <br /> October 22, 2003 at which time the following members of the Zoning Board of Appeals <br /> were present and acting throughout: Robert Nelson, James Regan and Marshall Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Tom O'Hara represents the petitioner in this hearing. They are seeking a 1.9 foot <br /> variance for the rear deck. In replacing the existing deck, the builder became aware that <br /> the setback requirements had changed since the deck was originally built and therefore <br /> they now need a variance. Marshall Brem moves to grant the Variance. Robert Nelson <br /> seconds the motion. <br /> GENERAL FINDINGS \' <br /> 1. that the subject property is located at 12 Summer Sea and contains 18,650 <br /> quare feet. <br /> ZS �2 <br />
