Mashpee Zoning Minutes—January 9, 2002 2 <br /> Board of Appeals <br /> Present: James E. Regan III, Robert G. Nelson, Richard T. Guerrera, Zella E. <br /> Elizenberry, Frederick R. Borgeson and Marshall A. Brem. (There was not an official <br /> appointment of members to sit on the Petition). <br /> Ms. Donna Bergamo and Messrs. McElhinney nney and Besse represented the Petition. Mr. <br /> Besse stated that the Cape Cod Commission has approved the proposed golf course <br /> expansion, which would replace the planned 67-house subdivision. Mr. Besse said that <br /> f p p <br /> the proposal would encroach on the required 50-foot buffer in a few areas. Landscape <br /> and plantings would be installed to mitigate the encroachment. Mr. Besse said that the <br /> Petitioner plans to maintain a 100-foot buffer on Quinaquisset Avenue to allow for safety <br /> of both the golfers and occupants of cars on the public way. Mr. Besse said that <br /> Willowbend Development Corporation owns some of the land on which there would be <br /> encroachment from the setback requirements, specifically the Shoestring Bay area and <br /> Sampsons Mill Road. <br /> Mr. Brem asked for the exact amount of Variance relief that the Petitioner is seeking. <br /> Mr. Besse indicated that approximately a 30-foot Variance would be needed. Mr. <br /> McElhinney said that the Cape Cod Commission required the Petitioner to maintain a <br /> i' certain buffer from the wetlands, making it necessary for Variance relief from the ZBA. <br /> Mr. Brem confirmed that Willowbend has always done an excellent job of landscaping. <br /> { Mr. McElhinney stated that the Petitioner has also worked closely with all of the <br /> neighbors, particularly on Quinaquisset Avenue. He indicated that the neighbors are in <br /> favor of the proposed golf course expansion as opposed to development of nearly 70 new <br /> homes. <br /> Mr. Regan said that the Board would require the Petitioner to submit a specific proposal <br /> r with all the pertinent information, including exact figures. He suggested that the Petition <br /> io <br /> should be continued until January 23, 2002. <br /> Mr. Guerrera questioned the exact areas that would be affected by the proposal. Mr. <br /> Besse said that there are two new areas on the public way—one on Quiniquisset Avenue, <br /> one on Sampsons Mill Road. There is also a 10-foot area on Shoestring Bay that would <br /> require Variance relief <br /> k <br /> t}F; <br /> Mr. McElhinney said that he realizes that the ZBA is unable to make any decisions until <br /> after the Cape Cod Commission issues its final decision. He said that the Petitioner <br /> wanted to update the Board on the status of the proposal. Mr. McElhinney asked for a <br /> continuance of the hearing and promised to submit specified form of relief being sought. <br /> No comments were received from abutters. <br /> (There was not a motion, second or agreement to continue the Petition). <br /> 4 <br /> iii <br />
