Dublirer V-02-10 8 Elizabeth Island Road <br /> Map 123 Parcel 131 <br /> i <br /> A Petition was filed on November 29, 2001 by Eric and Ellen K. Dublirer of <br /> Framingham, Massachusetts for a Variance from Section 174-31 of the Zoning By-laws <br /> to vary the front setback and lot coverage requirements to allow for construction of an <br /> addition to a pre-existing, non-conforming dwelling on property located in an R-3 zoning <br /> district at 8 Elizabeth Island Road (Map 123 Parcel 13 1) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on December 21 and <br /> December 28, 2001, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 9, 2002, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: James E. Regan III, Robert G. Nelson <br /> and Zella E. Elizenberry. <br /> I <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. j <br /> Mr. David Sanicki of Cape & Islands Engineering represented the Petition and <br /> submitted photos of the subject property and stated that the size of the proposed addition <br /> to the existing dwelling is 14 x 28 feet. Mr. Sanicki also said that the Petitioner would be <br /> i <br /> willing to trim down the size of the existing deck in order to reduce the total lot coverage <br /> with the proposed addition. <br /> I <br /> Mr. Dublirer also attended the meeting and stated that he wants to maintain the <br /> dwelling as a ranch-style home. He said that he is selling his home in Framingham and <br /> moving to Mashpee on a year-round basis. After some discussion, the Board and the <br /> Petitioner came to an agreement of reducing the lot coverage with removal of a portion of <br /> i <br /> the existing deck. The Board voted unanimously to grant a Special Permit to allow for <br /> i <br /> f <br /> i4:,t <br />
