Mell of Mashpee, Massachusetts for a Variance from Section 174-31 of the Zoning By-laws to !I vary the side setback requirements to allow for addition of a deck to an existing home on property located in an R-3 zoning district at 90 Bluff Avenue (Map 118 Parcel 55) Mashpee, MA. II Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Cape Cod Times, a newspaper of general circulation in the Town of Mashpee, on February 11 and III I February 18, 2002, a copy of which is attached hereto and made a part hereof. A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, February 27, 2002, at which time the following members of the Zoning 11 l I Board of Appeals were present and acting throughout: James E. Regan III, Frederick R. I I I' I Borgeson and Marshall A. Brem. �� jII The Mashpee Zoning Board of Appeals issues this Decision pursuant to the j provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of II III Mashpee Zoning By-laws. Mr. Richard W. Mell presented his Petition. After a lengthy discussion with the .III Board,the Petitioner failed to establish the required findings for grant of a Variance. Mr. i� l .I Mell requested Withdrawal Without Prejudice of the above-referenced Petition.
