T . <br /> r <br /> Town of Mashpee <br /> 16 Great JVeck oad Vorth <br /> A MASHPEE ZONING BOARD OF APPEAL <br /> DIE Sla'lashpee, Massachusetts 02649 Ii <br /> Decision for a Special Permit <br /> RE: Lambrini Menounos & Effie Mellos SP-02-32 140 Captains Row <br /> Map 96 Parcel 23 <br /> A Petition was filed on January 17, 2002 by Lambrini Menounos and Effie <br /> Mellos of Somerville, Massachusetts for a Special Permit under Section 174-20 of the <br /> Zoning By-laws to demolish an existing structure to allow for construction of a new <br /> single-family home on property located in an R-3 zoning district at 140 Captains Row it <br /> (Map 96 Parcel 23) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Cape Cod Times, a <br /> newspaper of general circulation in the Town of Mashpee, on February 11 and f; <br /> February 18, 2002, a copy of which is attached hereto and made a part hereof. <br /> The Zoning Board of Appeals received a fax from J. E. Landers-Cauley, engineer ! <br /> for the project, requesting a continuance of the above-referenced Petition. The Board <br /> voted unanimously to continue the Petition until March 27, 2002. <br /> I L <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, March 27, 2002, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Frederick R. Borgeson, Richard <br /> T. Guerrera and Marshall A. Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> At the continued - <br /> hearings on March 27, 2002, Mr. J. E. Landers Cauley <br /> represented the Petition and stated that plans call for demolition of the existing antiquated j <br /> dwelling, which was built in the early 1960's. The proposed construction of a new <br /> single-family home on the subject property would accommodate large family gatherings. I'L <br /> The Petitioner is also seeking Variance relief from the front setback requirements to j <br /> allow for a proposed 4-foot wide entranceway. Mr. Landers-Cauley said that the <br /> proposed entranceway was designed to be aesthetically appealing. <br /> The Conservation Commission has approved the proposal. The Board of Health <br /> has approved the proposed installation of a denitrification system on the subject property. <br /> No comments were received from abutters. <br /> !
