Notice was given by P <br /> ubli <br /> cation in The Cape Cod Times, a <br /> newspaper of general circulation in the Town of Mashpee, on February 11 and <br /> February 18, 2002, a copy of which is attached hereto and made a part hereof. <br /> Mr. J. E. Landers-Cauley, engineer for the project, faxed a request fora <br /> continuance of the above-referenced Petition. The Board voted unanimously to continue .j <br /> the Petition until March 27, 2002. A Public Hearing was held on the Petition at the <br /> Mashpee Town Hall on Wednesday, March 27, 2002, at which time the following <br /> I' <br /> members of the Zoning Board of Appeals were present and acting throughout: Frederick <br /> R. Borgeson, Richard T. Guerrera and Marshall A. Brem. I <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the III <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> � III II! <br /> At the continued hearings on March 27, 2002, Mr. J. E. Landers-Cauley <br /> represented the Petition and stated that plans call for construction of a new <br /> single-family home on the subject property. The Petitioner is seeking Variance relief <br /> from the front setback requirements to allow for a proposed 4-foot wide entranceway. <br /> Mr. Landers-Cauley said that the proposed entranceway was designed to be aesthetically <br /> appealing. The Board voted unanimously to grant a Special Permit to allow for <br /> demolition of the existing dwelling on the subject property. I' <br /> The Conservation Commission has approved the proposal. The Board of Health <br /> happroved <br /> as <br /> � <br /> the proposed installation of a denitrification system on the subject property. I � <br /> i i it <br /> No comments were received from abutters. <br /> iI I <br /> I . <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the l <br /> Petitioner did not meet the criteria necessary for the granting of a Variance. Upon motion <br /> duly made and seconded, the Zoning Board of Appeals voted unanimously on March 27, I! <br /> 2002 to Deny Without Prejudice the Request for a Variance, V-02-31. <br />
